LICENSE AGREEMENT

By purchasing and downloading digital items from The Digi Bistro, you are purchasing a License to use specific artworks (fonts, alphabets or designed graphics) that are strictly owned by The Digi Bistro or its business entities. You are hereby acknowledging that all designed PAPERS, IMAGES, SVGs, DXFs, PNG, JPEGS, MTCS, SCALs, GSDs, and Silhouette STUDIO files are the sole property of the individual owner(s), The Digi Bistro. By downloading these digital files of any artwork from The Digital Bistro, in summation, you are agreeing that the artwork in both physical and digital form is not to be claimed as yours nor altered. You agree to the terms that you are a purchasinga single license and the artwork is licensed to you as a single license user. License may be revoked at any time for misuse of files.

You are AUTHORIZED to:

• To install and use the artwork files on a single computer for your own PERSONAL use.
• Use the graphics of these files in any of your PERSONAL projects, ONLY.
• Resize or recolor, post to your layouts, blog/website and publish in galleries and magazines as long as credit is properly given to The Digi Bistro at: http://www.thedigibistro.com or Cheryl Evans at (Cher’s Studio): http://www.cherevansstudio.blogspot.com.

You are NOT AUTHORIZED to:

• To share, loan, rent, resell, or distribute the artwork files to anyone.
• To install or use the artwork files on more than one computer at a time.
• To make copies of the artwork files other than for back-up purposes.
• To copy, reproduce, modify, or create derivative works from the artwork files or the artwork image for the purpose of resale, distribution, or for any commercial use.

LIMITED WARRANTY

The Digi Bistro warrants that all artwork purchased shall be free from defects for 30 days from the time the artwork files are sent to you. Should a problem exist in any files downloaded within the 30-day timeframe, please contact us by email: support@thedigibistro.com or through our website by clicking on the Contact Us link. If you have some doubts or questions regarding the proper uses for these images or copyright issues that are not answered in this license agreement, please do not hesitate to contact us at our electronic address listed in this agreement. Please do not distribute our free files to your friends but direct them to our blogs at http://www.cherevansstudio.blogspot.com or http://thedigibistro.com/blog/

LIMITATION OF LIABILITY

The Digi Bistro’s sole responsibility is to abide by the limited warranty as stated above. Under no circumstances, including negligence, shall The Digi Bistro be responsible for any damages or loss that may result from the use of, or inability to use the graphic images, artwork, designs or files. If any legal action arises out of copyright infringement, The Digi Bistro shall be indemnified and held harmless of any and all costs or damages that you or The Digi Bistro incurs.

Licensee hereby acknowledge and agree that Licensee is licensing the products for non-commercial, personal use. Licensee hereby agrees to pay liquidated damages to Licensor in the amount of $6,000.00 for any non-personal and/or commercial use. In addition, should Licensor incur any attorney fees or other costs in collecting and/or enforcing this liquidated damages provision, Licensee agrees to reimburse Licensor for all such fees and/or costs. The parties acknowledge that the liquidated damages set forth above are reasonable in amount, that actual damages would be extremely difficult or impractical to determine and that any dispute or potential dispute over actual damages would be disruptive to the businesses of the parties so that it is in both parties' best interest to have determined the amount of such reasonable liquidated damages.
